On November 02, 2004, 62% of Montana voters approved Initiative 148, effective November 02, 2004, essentially removing state-level criminal penalties on the use, possession and cultivation of marijuana, by patients possessing the medical recommendation from their physician, stating that he or she may benefit from the medical use of marijuana.

The Montana Patient Registry fee is $75 for new applications, and renewals. The Montana Marijuana Registry is mandatory, and does NOT accept other state’s registry cards. 


The State of Montana has a legalized medical marijuana program, which allows patients to receive a medical marijuana recommendation from a certified physician, and apply for a state-issued Montana Medical Marijuana Card, permitting the patient to purchase marijuana for medicinal use, as per Montana state guidelines.

Please note: In order to become a legal medical marijuana patient you must first have a qualifying condition as outlined by the department of health services and/or department of justice. On April 28, 2011, SB 423 was passed, and transmitted to Montana’s Governor, on May 03, 2011. Effective July 01, 2011, SB423, changed the application process to require a Montana driver’s license or state issued ID card; and requires that all patients with a chronic pain diagnosis, have a second physician.

“A provider or marijuana-infused products provider may assist a maximum of three registered cardholders”, and “may not accept anything of value, including monetary remuneration, for any services or products provided to a registered cardholder.” 

* Please note: Montana’s medical marijuana laws, have never technically been enacted — as soon as the initial restrictions were passed by legislature, they were immediately suspended without taking effect, resulting in years of appeals. In February 2016, the Montana Supreme Court upheld sections of the law, including limiting the number of patients dispensaries are allowed care for to no more than three (3) patients, however it struck down the portion of the law that specifically prohibited them from selling medical cannabis. However, the newly upheld law has also never been enacted, and too, remains hung up in appeals — until November, when a recreational-use measure, that is set to be placed on the ballot, is expected to pass.


Montana law states that, “registered cardholders are limited to 12 seedlings (<12”), 4 mature flowering plants, and 1 ounce of usable marijuana”, however, “if a registered cardholder assigns a caregiver, they cannot grow for themselves.”
