On November 07, 2000, 65% of Nevada voters approved Ballot Question 9, effective October 01, 2001.

Ballot Question 9 effectively removes state-level criminal penalties on the use, possession and cultivation of marijuana, by qualifying patients who have a “written certification” from their physician, stating that he or she may benefit from he medical use of marijuana.

On the Nevada Medical Marijuana Program website, is a list of 15 open dispensaries currently serving the patients of the state — home cultivation is ONLY permitted in specific circumstances.

The Nevada Patient Registry fee is $25 for new applications, and $75 for the patient ID card. The Nevada Marijuana Registry is mandatory, and as of April 01, 2014, does accept other state’s registry cards, with an affidavit.


 

The State of Nevada has a legalized medical marijuana program, which allows patients to receive a medical marijuana recommendation from a certified physician, and apply for a state-issued Nevada Medical Marijuana Card, permitting the patient to purchase marijuana for medicinal use, as per Nevada state guidelines.

NEVADA PROGRAM UPDATE

On October 01, 2001, Assembly Bill 453, created a state registry for those patients who physicians have recommended medical marijuana, while also tasking the Department of Motor Vehicles with issuing identification cards. It further stipulates that no state money will be used for the program — the program is to be funded entirely by donations.

On June 12, 2013, Nevada Governor Brian Sandoval, effectively signed and amended Senate Bill 374, providing for the registration of medical marijuana establishments authorized to cultivate or dispense marijuana, or manufacture edible marijuana products or marijuana-infused products, for sale to patients authorized to to legally access, possess and use marijuana for medical use. Additionally, between April 01, 2014 and March 31, 2016, non Nevada residents are required to sign an affidavit attesting to the fact that he or she is entitled to engage in the medical use of marijuana in his or her state or jurisdiction, of residency. As of April 01, 2016, the affidavit will be replaced by computer cross-checking between Nevada and other jurisdictions. Finally, patients who have been cultivating their own medical marijuana since before July 01, 2013, will only be allowed to continue cultivation until March 31, 2016.

Effective April 01, 2014, the Department of Health and Human Services adopted regulations based on the previous amendment.


NEVADA POSSESSION AND CULTIVATION REGULATIONS

In the state of Nevada patients, or their appointed caregiver, may legally possess no more than two and a half (2.5) ounces of usable medical marijuana in a 14-day period, and no more than 12 plants.


NEVADA MEDICAL MARIJUANA REGISTRY

The Nevada law established a confidential state-run patient registry, to issue identification cards to qualifying patients. Patients who refrain from joining the registry, or those who are found to possess a greater quantity of cannabis than is legally allowed by law, may argue the “affirmative defense of medical necessity”, if arrested. Legislators have included a preamble to the legislation stating: 

“The state of Nevada as a sovereign state has the duty to carry out the will of the people of this state and regulate the health, medical practices and well-being of those people in a manner that respects their personal decisions concerning the relief of suffering through the medical use of marijuana.” 

In a separate provision, the Nevada School of Medicine, are required to “aggressively” seek federal permission to establish a state-run medical marijuana distribution program.
