New Mexico Medical Marijuana

On March 13, 2007, Senate Bill 523 “The Lynn and Erin Compassionate Use Act”, was approved by the House 36-31 and the Senate 32-3, effective July 01, 2007. 

Senate Bill 523 effectively removed all state-level criminal penalties on the use and possession of marijuana by patients “in a regulated system for alleviating symptoms caused by debilitating medical conditions and their medical treatments”. The New Mexico Department of Health has been tasked with administering the program and registering patients, caregivers, and providers.

“Currently, there are 23 independent Licensed Nonprofit Producers (LNPP). These are the agencies where those actively enrolled in the program purchase product. The NM Department of health does not provide medical cannabis or set the prices. Patients must contact each LNPP directly to initiate the registration process. The New Mexico Patient Registry is free. The New Mexico Marijuana Registry is mandatory, and does NOT accept other state’s registry cards.

The State of New Mexico has a legalized medical marijuana program, which allows patients to receive a medical marijuana recommendation from a certified physician, and apply for a state-issued New Mexico Medical Marijuana Card, permitting the patient to purchase marijuana for medicinal use, as per New Mexico state guidelines.

New Mexico patients are legally allowed to possess up to six ounces of “usable” cannabis, and a maximum of four mature plants and twelve seedlings. The state defines “usable” cannabis as dried leaves and flowers — seeds, stalks and roots are not included. Primary caregivers may not grow for more than 4 qualified patients.
